Public offering (website)


This document is a public offer and includes the terms and conditions of use of dialectiqa.com, as well as the rights of the user. In the event that the user places an order on the website, this document constitutes an agreement between the user and dialectiqa.com.


1.Definition of terms:

  • dialectiqa.com (hereinafter referred to as “Website”, “Platform”, “Our”) – established in accordance with the legislation of Georgia by individual entrepreneur Marina Fedorov (business registration number: 306455680);

  • Trader-  According to the Law of Georgia on the Protection of Consumer Rights, a trader is any natural person, legal entity, or association of persons acting within the scope of commercial activity, as well as any other person acting on behalf of a trader;

  • Consumer - According to the Law of Georgia on the Protection of Consumer Rights, a consumer is any natural person who is offered or who acquires or subsequently uses goods or services primarily for personal consumption and not for the purpose of carrying out commercial, entrepreneurial, trade or other professional activities;

  • Confidential information - any information that is not generally publicly available and that has become known to the employee and/or to which he or she has access based on and as a result of the employment relationship;

  • Personal data - any information relating to an identified or identifiable natural person. A natural person is identifiable when he or she can be identified, directly or indirectly, including by name, surname, identification number, geolocation data, electronic communication identifiers , physical, physiological, mental, psychological, genetic, economic, cultural or social characteristics;

  • Data processing - any operation performed on data, including their collection, retrieval, access, photography, video and/or audio monitoring , organization, grouping, interconnection, storage, alteration, retrieval, retrieval, use, blocking, erasure or destruction, as well as disclosure of data by transmission, disclosure by way of disclosure , dissemination or otherwise making available;

  • Data subject (hereinafter referred to as " User ") - any natural person about whom data is processed;

  • Data subject's consent (hereinafter referred to as "user's consent") − the data subject's freely and clearly expressed will, after receiving relevant information , to the processing of data about him or her for a specific purpose, by active action, in writing (including electronically) or orally;

  • Person responsible for processing - a natural person, legal entity or public institution that, individually or jointly with others, determines the purposes and means of data processing and carries out data processing directly or through a person authorized to process it;

  • Data processor - a natural person, legal entity or public institution that processes data for or on behalf of the controller. A natural person in an employment relationship with the controller is not considered a data processor;

  • Third party - a natural person, legal entity or public institution, other than the data subject, the personal data protection service, the person responsible for processing, the person authorized to process, the special representative and the person authorized to process the data under the direct instruction of the person responsible for processing or the person authorized to process;


2. About the website:

  1. The platform provides the customer with the opportunity to purchase and receive the products we offer.

  2. As a retailer, we are committed to providing our customers with the products they have purchased .


3. User account on the platform and terms of placing an order:

  1. In order to fully utilize the platform's services, it is essential for the user to create their own account on the website. To create one, the user must follow the instructions posted on the platform and provide the requested information;

  2. The user is fully responsible for the accuracy of the data provided when creating an account;

  3. The customer places an order on the platform by adding products to the cart and filling in the required data;

  4. After placing an order, the buyer receives confirmation via email or messenger.

  5. The website reserves the right to refuse to fulfill the order if the product is out of stock or there is another objective reason;

  6. Payment for the order is made using one of the methods offered on the website (bank card, electronic payments, etc.).

  7. The buyer is obliged to pay for the order within 24 hours of placing it, otherwise the order will be considered canceled, unless otherwise provided for by the terms of the promotion or individual offer.


4.Goods Delivery :

  1. 4.1 The goods are delivered throughout the territory of Georgia/ countries of EU by the method chosen by the buyer (courier service, postal delivery, etc.);

  2. 4.2 Delivery times and costs are indicated when placing an order.

  3.  4.3 The carrier is responsible for damage to or loss of goods during transportation from the moment the order is transferred to it.


5.User Rights :

  1. According to Article 13 of the Law of Georgia on the Protection of Consumer Rights, the consumer has the right to withdraw from a distance contract and/or an off-site contract within 14 calendar days without giving any reason. This period is calculated from the date of receipt of the product.

  2. The consumer is obliged to send the trader a completed form or other unambiguous evidence, which reflects the consumer's decision to return the goods, within the specified period. The burden of proving the exercise of the right to withdraw from the contract provided for in this Article within the specified period lies with the consumer.   1. The consumer does not have the right to withdraw from the contract if: 

a) the goods or services supplied are made to the individual order of the consumer or are clearly tailored to his personal needs; 

b) the delivered goods are perishable or have a short shelf life; 

c) the appearance, packaging and/or labeling of the product will be damaged due to the fault of the consumer; 

d) The delivered goods, due to their characteristics, were inseparably combined with other goods at the time of delivery. 

e) The price of the delivered goods depends on changes in the financial market, which the trader cannot control and which occurred within the period specified in this document.

  1. In the event of the consumer's withdrawal from the contract, he will not be liable for any costs (including delivery costs), except in cases where the consumer has chosen a more expensive delivery service than the standard delivery service offered by the trader or the price of the goods has been reduced as a result of a benefit that is not related to determining the nature, characteristics and functioning of the goods.

  2. The trader is obliged to refund the amount paid by the consumer within 14 calendar days of receiving the notification of the return of the goods. The trader has the right to refuse to refund the amount until the goods are returned or until the consumer receives proof of shipment of the goods, whichever is earlier.

  3. The refund will be made using the same payment method used by the customer, unless the customer agrees to use a different payment method.


6.Personal Data Protection Terms and Conditions

  1. Using the platform constitutes the user's consent to the privacy policy. Accordingly, the user grants dialectiqa.com the right to process, store and use the personal information provided by the user . The said information will be used by the platform for the purposes of providing the service, taking into account the applicable legislation.

  2. The legal basis for the processing of personal data by the website is: the user's consent to the processing of his or her personal data, the processing of personal data is necessary to provide services to the user and to fulfill the obligations imposed on the website by law.

  3. Purpose of processing users' personal data: 

  • Effective communication with the customer; 

  • Providing information about purchases made by the user; 

  • Notification of updated website data to users; 

  • Improving the quality of website service; 

  • Proper fulfillment of the website's legal obligations; 

  • Providing feedback to us by the user; 

  • Protection of legitimate interests; 

  • Carrying out marketing and other activities; 

  • Facilitating the resolution of complaints submitted by the user; 

  • Prevention of crimes stipulated by the Criminal Code of Georgia; 

  • Other legitimate purposes granted by the Law of Georgia on Personal Data Protection.

  1. Upon request by the user, the platform is obliged to correct, update, supplement, block, delete or destroy personal data if it is incomplete, inaccurate, not up-to-date, or if its collection and processing were carried out in violation of the requirements of the law.

  2. The user has the right to apply to the Personal Data Protection Service or court in case of violation of the rights provided for by the Georgian Law on Personal Data Protection.

  3. The user has the right to withdraw his/her consent to the website at any time and request the termination of data processing and/or the destruction of the processed data. In such a case, the platform will terminate the data processing and/or destroy the processed data in accordance with the legislation.

  4. The Platform shares personal data with partner courier service companies (e.g. Georgian Post), which ensure the delivery of purchased products to the user at the address specified by the user. The following information about the user will be transferred to partner courier service companies: order details, name, surname, address and contact number. The information provided to partner courier companies will be used only for the purpose of delivering the purchased products.

  5. Sharing the user's personal data may be necessary in cases provided for by the current legislation of Georgia, for the purpose of detecting, investigating or preventing a crime.


7.Force majeure:

  1. The parties are exempt from liability for full or partial non-fulfillment of obligations in the event of a force majeure situation, during which it is impossible to fulfill the obligations provided for in this Agreement;

  2. Force majeure situations mean circumstances that did not exist and which the parties could not have taken into account at the time of concluding this Agreement, as well as the occurrence, impact of which the parties could not have prevented or overcome. Such circumstances shall be considered natural disasters;

  3. The party for whom the fulfillment of obligations has become impossible due to a force majeure situation is obliged to notify the other party within a reasonable period of time.


8.Platform Responsibility:

  1. The Platform does not guarantee that it will be continuously available and operate without interruption.

  2. The platform is liable for any damage caused in the event of a website malfunction.


9.Dispute Resolution:

  1. The relationship between the user and the platform is regulated in accordance with the legislation of Georgia.

  2. In case of any claim by the user, he/she is entitled to contact the platform at the following electronic address - customer.service@dialectiqa.com.

  3. The platform will review the written complaint and provide feedback to the user within 14 (fourteen) calendar days of receipt.

  4. Any dispute arising between the User and the Platform shall be resolved through negotiation. In the event that the negotiation is unsuccessful, the User shall have the right to apply to the LEPL - Georgian Competition and Consumer Protection Agency or a court within the system of common courts of Georgia.


10.Changes and additions

  1. This document may be changed unilaterally, at the initiative of the website, at any time, about which registered users must be informed a reasonable period of time in advance.
